Terms of Service

These Terms of Service ("Terms") govern your use of Webleadr and constitute a legally binding agreement between you and Webleadr, a sole proprietorship registered in Belgium. Please read them carefully before using our service.

1. Acceptance of Terms

By accessing or using Webleadr, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our service.

You must be at least 16 years old to use this service. By using the service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Your continued use of the service after any modifications to these Terms constitutes acceptance of the updated Terms.

2. Description of Service

Webleadr is a lead generation platform that helps web designers and agencies discover potential web design clients and businesses without websites. The service includes:

• Business search and discovery via geographic area selection
• Business listing management with lead organization tools
• Social media enrichment (Facebook, Instagram, TikTok) for business profiles
• Email discovery and enrichment from public sources
• Website health analysis (SSL, security headers, performance, SEO meta tags)
• AI-powered website quality evaluation based on screenshot analysis
• Data export (JSON format) for business leads
• Referral program

3. User Accounts

3.1 Account Registration

To access the service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or use of your account

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Authentication Methods

You may create an account using email and password, or via OAuth with Google. Google OAuth is subject to Google's own terms and privacy policy.

4. Acceptable Use Policy

4.1 Permitted Use

You may use the service for lawful business purposes only, including:

• Finding potential web design clients
• Researching businesses for legitimate outreach
• Managing your leads and customer relationships
• Exporting business data for your own legitimate use

4.2 Prohibited Activities

You agree not to use the service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Send spam, unsolicited communications, or engage in harassment
• Distribute malware or engage in cyberattacks
• Attempt to reverse engineer, decompile, or extract source code
• Use automated systems, bots, or scripts to abuse the service
• Resell, redistribute, or commercially exploit business data obtained through the service without our authorization
• Create fake accounts or impersonate others
• Interfere with the proper functioning of the service
• Violate anti-spam and marketing laws (CAN-SPAM, GDPR, PECR, CASL)
• Use the service for any purpose that is unlawful or harmful to others

4.3 Outreach Compliance

When contacting businesses found through our service, you are solely responsible for ensuring your outreach activities comply with applicable laws, including:

• CAN-SPAM Act (US)
• GDPR electronic communications and marketing consent requirements (EU)
• Privacy and Electronic Communications Regulations (PECR, UK)
• Anti-Spam Legislation (CASL, Canada)
• Any other applicable national or international laws

Webleadr provides business data for informational purposes. How you use that data in your outreach is your sole responsibility.

5. Credits and Payment

5.1 Credit System

Our service operates on a credit-based, pay-as-you-go system. One credit equals one business lead fetched. Credits are purchased in sets of 100. There are no subscriptions, recurring charges, or monthly fees.

• Minimum purchase: 100 credits (1 set)
• Maximum balance: 4,000 credits
• Pricing: $19 per 100 credits (prices include VAT where applicable)
• Credit expiry: Credits never expire and remain in your account until used
• First-purchase bonus: 20% bonus credits on your first purchase

5.2 Payment Processing

All payments are processed securely by Paddle, which acts as our Merchant of Record. This means Paddle handles payment collection, invoicing, and tax compliance (including VAT) on our behalf. By making a purchase, you agree to Paddle's Terms of Service and Privacy Policy.

Accepted payment methods are determined by Paddle and typically include credit/debit cards (Visa, Mastercard, American Express), PayPal, Apple Pay, and Google Pay. Pricing may be displayed in different currencies depending on your location.

5.3 Refund Policy

• Refunds are available within 14 days of purchase
• Once any portion of credits has been spent, refunds are no longer available
• Refund requests must be submitted to amin@webleadr.com
• Refunds are processed through Paddle and may take up to 10 business days to appear on your statement

5.4 Pricing Changes

We reserve the right to modify credit pricing at any time. Changes will not affect previously purchased credits. We will provide reasonable advance notice of significant price changes through the service or by email.

6. Referral Program

Our referral program allows you to earn free credits by referring new users:

• Reward: 40 credits after a referred user makes their first credit purchase and the refund window has passed
• Maximum earnings: 400 credits total (10 successful referrals)
• Referral credits do not expire
• Only valid referral codes may be used
• One bonus per new referred user
• No self-referrals, fake accounts, or abuse of the referral system
• We reserve the right to modify, suspend, or terminate the referral program at any time

7. Data Accuracy and AI-Generated Content

7.1 Data Sources and Accuracy

Webleadr provides business data sourced from publicly available third-party sources, including:

• Google Maps listings (from publicly available sources)
• Business websites (enriched with contact details, emails, and social media links)
• Facebook business pages (enriched with email addresses from public pages)
• Google search results (via Serper.dev, for finding social media profiles)

While we strive to provide accurate data, we cannot guarantee 100% accuracy. Data may be outdated, incomplete, or incorrect due to changes on the source websites, business closures, or data collection limitations. We encourage you to verify important information directly with the businesses before acting on it.

7.2 AI-Generated Evaluations

Our service uses artificial intelligence (OpenAI GPT-4o-mini) to generate the following evaluations for each business:

• Website Score: A quality rating (1-10) based on visual analysis of a website screenshot, including perceived content density and completeness
• Web Health Grade: An overall grade (A-F) based on SSL status, security headers, server response time, and other technical factors

These evaluations are generated by AI and are intended as general indicators only. They may not perfectly reflect the actual quality, completeness, design, or security of a website. You should not rely solely on AI-generated scores when making business decisions. We are not liable for any decisions made based on AI-generated evaluations.

7.3 Email and Contact Data

Email addresses and contact details discovered through our enrichment process are sourced from publicly accessible websites and social media profiles. These may not always be current, may belong to former employees, or may be general contact addresses rather than direct contacts. You should verify contact details before using them for outreach.

8. Intellectual Property

8.1 Our Rights

The service, including all content, features, functionality, software, design, and underlying technology, is owned by Webleadr and protected by intellectual property laws. This includes but is not limited to the website design, code, logos, and documentation.

8.2 Your Rights

You retain ownership of content you create or upload to the service (notes, custom lead statuses). By using the service, you grant us a limited, non-exclusive license to process, store, and display your content as necessary to provide the service.

8.3 Business Data

Business data accessed through the service is provided for informational purposes to support your legitimate business activities. You may not reproduce, distribute, sell, or commercially exploit this data in bulk or as a competing service without our prior written authorization.

9. Third-Party Services

The service integrates with the following third-party providers:

• Supabase: Database, authentication, real-time features, and serverless functions (EU)
• Third-party data collection service: Business data collection, contact enrichment, screenshots, and web health reports (US)
• OpenAI: AI-powered business filtering, website detection, social profile verification, and website evaluation (US)
• Serper.dev: Google Search API for finding business social media profiles (US)
• Paddle: Payment processing, invoicing, and tax compliance (UK/US)
• Resend: Transactional and marketing email delivery (US)
• PostHog: Essential error logging and consent-based product analytics (EU)
• Cloudflare: Application hosting, CDN, and DDoS protection (Global)
• Google: OAuth authentication provider (US)
• CARTO / OpenStreetMap: Map tiles for the geographic search interface

Use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or policies of these third-party services.

10. Disclaimers

10.1 As-Is Basis

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of business data or AI-generated evaluations
• Uninterrupted or error-free operation
• Correction of defects or errors
• That the service will meet your specific requirements or expectations

10.2 No Guarantee of Results

We do not guarantee specific results from using the service, including but not limited to: number of leads generated, conversion rates, business revenue, or the accuracy of contact information. The value you derive from the service depends on your own efforts and external factors beyond our control.

10.3 Business Data Disclaimer

Business data provided through our service is obtained from public sources and may not always be current or accurate. Businesses may have closed, changed their contact information, or updated their websites since the data was collected. You are responsible for independently verifying any business data before relying on it.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Webleadr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of profits, revenue, or business opportunities
• Loss of data or goodwill
• Business interruption
• Cost of substitute services
• Damage arising from your use of business data or AI-generated evaluations
• Damage arising from your outreach activities using data from the service

Our total aggregate liability shall not exceed the total amount you paid for the service in the 12 months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Webleadr and its operator from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights (including intellectual property and privacy rights)
• Your outreach activities using data obtained from the service
• Any misrepresentation you make about your identity or business

13. Termination

13.1 By You

You may terminate your account at any time by deleting it through Settings > General > Danger Zone in the application, or by contacting us at amin@webleadr.com. Upon account deletion, your business leads, profile data, and enrichment results will be permanently removed from our database. Unused credits will be forfeited.

13.2 By Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• We detect fraudulent, abusive, or suspicious behavior
• Your account is inactive for an extended period
• We are required to do so by law or legal process
• We discontinue the service (with reasonable notice where possible)

13.3 Effect of Termination

Upon termination: (a) your right to use the service will cease immediately; (b) unused credits will be forfeited without refund; (c) Sections 7, 8, 9, 10, 11, 12, and 17 will survive termination.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice within the service. The revised Terms will take effect on the date indicated at the bottom of this page.

Your continued use of the service after the effective date of changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the service and delete your account.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms shall be resolved as follows:

1. Good faith negotiation: The parties shall first attempt to resolve the dispute through direct communication in good faith.
2. Mediation: If negotiation fails within 30 days, the parties may attempt mediation through a mutually agreed mediator.
3. Court proceedings: If mediation fails or is not pursued, any dispute shall be subject to the exclusive jurisdiction of the courts of Bruges (Brugge), Belgium.

For consumers (as defined by the Belgian Economic Law Code), the applicable mandatory consumer protection provisions shall apply regardless of the governing law clause.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Webleadr regarding the service, and supersede any prior agreements or understandings.

16.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

16.3 No Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us.

16.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16.5 Language

These Terms are provided in English. In the event of any discrepancy between the English version and any translation, the English version shall prevail.
